Who you are buying from
This shop is operated by FRANK & ADAM APPAREL LLC, a Florida limited liability company, trading as Frankie & Adam, at 3051 Tech Drive N, Suite 100, St Petersburg, FL 33716, United States. Who can order
You must be at least 18 years old and able to enter into a contract to order from this site. We sell to adults buying clothing for children, not to children. We do not offer accounts, and we do not knowingly accept orders from anyone under 18.
We ship to addresses within the United States only. We do not ship internationally.
Products and descriptions
We describe every garment as accurately as we can: fibre content by percentage, care instructions, country of origin, flat measurements in centimetres with a tolerance of ±1 cm, and the four safety facts required for children’s products.
- Sizes are standing heights in centimetres. Ages appear in brackets as a rough reference and are not the size.
- Colours on screen vary between displays. We photograph on a neutral cream background in daylight and do not retouch colour.
- Measurements are of the garment laid flat, not of a body. The size guide explains how to compare the two.
- Stock is finite. If something sells out between your order and our picking it, we will contact you and refund that line in full.
Prices, currency and tax
- All prices are in United States Dollars (USD) and are shown as such throughout this site.
- Prices exclude sales tax, which is calculated at checkout from your delivery address.
- Shipping is a flat USD $6.95 within the United States, or free on orders over USD $75 before tax.
- We may change prices at any time, but never after you have placed an order. The price you are charged is the price shown when you ordered.
- If a price is obviously wrong — a mis-keyed figure rather than a low price — we will contact you before processing and you may cancel with a full refund.
Placing an order
Adding items to your basket and completing checkout is an offer to buy. The contract forms when we send you an order confirmation email. If we cannot accept your order we will tell you and refund any payment in full.
Before you can continue at checkout you must complete every required field and confirm you have read these terms, the returns policy and the privacy notice. Where your basket contains children’s sleepwear or adult companion pieces, you must separately acknowledge the notices shown — the button stays disabled until you do.
Payment and security
Payment is taken at the time of order through a payment provider. Card details are entered into the provider’s own PCI DSS compliant form; they are not handled or stored on our servers, and we never see a full card number. This site is served over HTTPS throughout.
We accept Visa, Mastercard, American Express and Discover.
Promotions and discounts
Where we run a promotion, these conditions apply unless the offer says otherwise:
- Free shipping over USD $75 is calculated on the basket subtotal before tax and after any discount, and applies to US addresses only.
- First-order discount codes are one use per customer and per email address, cannot be combined with another code, and do not apply to gift sets.
- Multi-pack pricing is a genuine saving against the price of buying the same items individually at their usual price. Any struck-through price shown is a price those items were actually offered at for a sustained period, not an inflated reference.
- Every promotion has an end date, shown with the offer.
- If a promotion is withdrawn, orders already placed under it are honoured.
No subscriptions
Everything on this site is a one-time purchase. There is no membership, no subscription, no store credit, no loyalty scheme and no recurring charge of any kind. Nothing you buy will auto-renew, because there is nothing to renew.
We deliberately do not offer a “next size, shipped automatically” box. Running one would mean keeping a record of a child’s growth over time, and we have chosen not to hold any information about a child at all.
Delivery
We dispatch within 1–2 business days of a completed order and delivery takes 3–7 business days within the United States.
If we cannot dispatch within the time stated, we will contact you, tell you the revised date, and give you the choice of accepting it or cancelling for a full refund. If we cannot reach you or you do not accept the revised date, we refund in full without you having to ask. Full detail is in the shipping policy.
Risk in the goods passes to you on delivery to the address you gave us. Please check the address carefully; we cannot recover a parcel delivered to an address you entered incorrectly, though we will help you try.
Cancellation and returns
You may cancel an order at no cost at any time before it is dispatched — email or call us and we will stop it and refund in full.
After delivery you have 30 days to return items that are unworn, unwashed and have their tags attached, for a full refund of the item price. Intimate garments — infant bodysuits and underwear — cannot be returned once the hygiene packaging is opened, unless they are faulty. Faulty or misdescribed goods can be returned at any reasonable time at our cost. The full process is in the returns policy.
Reviews and endorsements
How we handle reviews, stated plainly:
- Reviews come from verified purchasers only and are published as written, edited only for length and to remove personal details.
- We do not pay for reviews, and we do not offer discounts, gifts, free products or entry into prize draws in exchange for one.
- We do not remove a review for being negative. We remove reviews only for abuse, for content unrelated to the product, or where they contain personal information.
- Any material connection is disclosed next to the review, clearly and in the same place a reader will see the review itself. That includes free product, payment, an affiliate relationship or an employment connection.
- We do not publish reviews or endorsements from children. Reviews are from adult purchasers only.
- We do not use artificially generated reviews or reviews bought from a third party.
Product safety
Our children’s garments are made to the standards set out on the safety standards page, which forms part of these terms. Two things it is important to be clear about here:
- Sleepwear is tight-fitting, not flame resistant. It complies through fit rather than treatment. Buy the size that matches the child’s height and do not size up.
- Adult companion pieces are not children’s products and the children’s safety standards do not apply to them.
Any recall or safety notice is published at our recall notices page and emailed to affected purchasers, whether or not they subscribed to anything.
Intellectual property
The content of this site, including photographs, text and the original patterns and motifs on our garments, belongs to us or is used with permission.
None of our garments carries a licensed character, film or television property, sports club emblem or third-party brand mark. Every print and motif is drawn for us or is in the public domain. This is a deliberate policy: children’s clothing is one of the most common categories for intellectual property infringement, and we do not want to be in that conversation.
Warranties and liability
We warrant that goods will match their description, be of satisfactory quality and be fit for ordinary use as clothing. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, or for fraud.
Subject to that, our total liability arising from any order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss.
Wear and tear, damage from misuse, and damage from washing contrary to the care label are not covered. Where a garment states a limit — for example that a rain set is water resistant rather than waterproof — performance beyond that limit is not covered.
Governing law
These terms, and any dispute arising out of them or out of any order, are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules. The state and federal courts located in Pinellas County, Florida have exclusive jurisdiction.
Nothing here affects consumer rights you have under the law of your own state that cannot be varied by agreement.
If any provision of these terms is held unenforceable, the rest remain in force. These terms, together with the privacy notice, the returns policy, the shipping policy and the safety standards page, are the whole agreement between us.
